1. Acceptance of Terms

By accessing and using VIPsAllowed ("the Platform"), operated by Tyga.Cloud Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and Tyga.Cloud Ltd.

2. Eligibility

  • You must be at least eighteen (18) years of age to use this Platform.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • By creating an account, you represent and warrant that you meet the eligibility requirements.

3. User Classifications

The Platform serves three types of users:

  • Creators: Users who publish content, set subscription prices, conduct live streams, and receive payments through the Platform.
  • Subscribers (Fans): Users who subscribe to Creators, purchase content, send tips, and interact with Creators.
  • Visitors: Individuals browsing the Platform without a registered account.

4. User Accounts

  • Each user may only maintain one account.
  • You may not share your account credentials with others.
  • You are responsible for all activity that occurs under your account.
  • You must promptly notify us of any unauthorised access or use of your account.

5. Creator Accounts

  • Creators must complete identity verification before receiving payouts.
  • Creators retain full ownership of their content but grant the Platform a non-exclusive, worldwide licence to display, distribute, and promote it within the Platform.
  • Creators are solely responsible for ensuring their content complies with all applicable laws and regulations.
  • Creators must connect a valid payment account (via Stripe Connect) to receive payouts.

6. Platform Services

VIPsAllowed provides the following services:

  • Content creation, publishing, and monetisation tools
  • Subscription management and recurring billing
  • Live streaming with real-time chat
  • Direct messaging between Creators and Subscribers
  • Content planning and social media cross-posting tools
  • Analytics and performance dashboards
  • Payment processing and creator payouts

7. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Post content that is illegal, harmful, threatening, abusive, defamatory, or harassing
  • Infringe on the intellectual property rights of others
  • Upload malware, viruses, or any harmful code
  • Impersonate any person or entity
  • Interfere with or disrupt the Platform's systems or infrastructure
  • Attempt to reverse-engineer, decompile, or extract source code from the Platform
  • Scrape, harvest, or collect data from the Platform without authorisation
  • Use the Platform to build a competing service
  • Violate the privacy of other users
  • Circumvent any content protection or access control measures

8. Payments, Fees, and Refunds

  • All purchases are final unless otherwise stated.
  • Subscription fees are charged in advance on a recurring basis (monthly, quarterly, or yearly).
  • The Platform retains a 7.5% fee on all creator earnings. Creators receive 92.5% of the transaction amount.
  • Creator payouts are processed via Stripe Connect to the Creator's connected bank account.
  • Refund requests are handled on a case-by-case basis. Contact support@vipsallowed.com for assistance.
  • We reserve the right to adjust pricing with 30 days' prior notice.

9. Intellectual Property

The Platform, including its design, code, logos, trademarks, and documentation, is owned by Tyga.Cloud Ltd and protected by intellectual property laws. You may not use our trademarks without prior written consent.

User-generated content remains the property of the respective Creator. By posting content, Creators grant the Platform a licence as described in Section 5.

10. Termination

  • You may delete your account at any time via Settings > Account.
  • We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.
  • Upon termination, your right to access the Platform ceases immediately.
  • Outstanding Creator balances will be paid out within 30 days of account closure, subject to fraud review.
  • We may retain certain data as required by law or for legitimate business purposes after termination.

11. Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law:

  • Tyga.Cloud Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total aggregate liability shall not exceed the amounts paid by you to the Platform during the twelve (12) months preceding the claim.
  • We do not guarantee uninterrupted or error-free service.

12. Indemnification

You agree to indemnify and hold harmless Tyga.Cloud Ltd, its directors, employees, and affiliates from any claims, liabilities, damages, or expenses arising from your use of the Platform, your content, or your violation of these Terms.

13. Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration, unless otherwise required by applicable consumer protection laws. You waive any right to participate in class-action proceedings.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
